After a summary judgement in US District Court totaling almost 106 million dollars was handed down to Kyle and Julliett Kimoto Sept. 2004 for a credit card scam they ran. I was solicited by Kyle a month later on yet another fraudulent money lending scam , this time it was real estate loans. I was close to forclosure thanks to ASC (Americas Servicing Company) ,but thats another story, and looking for refinacing when I called Kyle at Safe Harbor Foundation from a mailer I had received.My world turned into hell after that.
Kyle was going by the name 'Kyle Reid' when I contacted him. Using fictisous names and corparations, 'Safe Harbor Foundation and Keystone Financial' ,tying up the money I had to pay my forbearence agreement and waiting right up to the time my foreclosure sale was to take place he got me to sign a loan agreement with a 30% mark up, a 6 month balloon interest only loan that had a deed in leiu of clause for noncompliance of loan agreement. I thought I could raise the money in time for the balloon and besides they are liscensed lenders this must be legal, right?
I lost my job 2 months after signing. I was 4 days late on my payment when they grabbed my title and had an eviction notice taped to my door along with a nasty letter 3 days after that. The letter made my wife angry so she started doing some investigating. The loan contract was illegal because it was created for illegal purposes ie niether Safe Harbor or Keystone Financial had licenses to do any lending or loan transactions in Nevada therefore went completely unregulated by state and federal agencies.The state and federal laws these guys broke at every step of this transaction amazed my wife and I as we poored over the regs thinking we had these low lifes.
I am writing this just days away from a court ordered eviction. I'm sadened by the absolute lack of concern shown by my state and federal government agencies that all agreed with me that laws had been broken but that ... So I can steal $80,000 in a mans home thats down on his luck and an easy target because he cant defend himself in some long civil court battle but steal a car you'll get arrested. Talked with FBI, Metro-Police.FTC,Fair Lending, State Attorney Generals office. Wasn't given a chance to present my side in court because my lawyer took my money and filed nothing in court.My wife and I will get back on my feet again, but I don't know about all those other people they did this to.

Yes it is a very interesting article, this husband & wife go from one scheme than onto to another. Funny though how they got voted "Husband of the year 2006 and Mrs Nevada 2006"...........How shameful is that?

Even though the families are incurring huge legal debts to keep up the fight.......just to save their home and family unity.......that is truly the saddess part of this story.......
That really is sad....Oh yeah and I meant to say...I enjoy reading your blog! Sorry, I must be tired because I think straight. I spend a lot of time in the Tampa, Fl area and their was recently a case involving real estate and fraud that was obserd. I don't know how people could first of all do things like that but what is so amazing to me is that they sometimes get away with it. In this case, they got caught. Thank goodness!
Yes, I know. The guy that I date is an attorney in Palm Harbor, Fl, and I am always hearing about people trying to scam the elderly population. It makes me sick!
Me too, but its not just the elderly thats endanger here in Florida, it is everyone.....Well sweetie, I'm off to sleep, long day tomorrow for me.....

I'm one of the scammed people in FL. Luckily, last year I escaped my nightmare mortagage without forclosure. But if closing was one day later I would have been screwed. All I have to say to people is hire a real estate attorney to look over your mortgage aggreement. I was flustered at the initial closing and signed paper without really looking at them. After the fact, I reallized that the mortgage guy have tacked on tens of thousands of dollars for his commission over the actual price, he had used the taxes already paid that year as something, the homeowners insurance and taxes were not included in the monthly payment.... OH and the homeowners association dues were 5 times what I had been told. SO... I as soon as I realized that the monthly payment was more that had been predicted and the other expenses were not included, we like you started trying to save enough money to "fix it" by refinancing. We 2 yrs came and went, no refinance and we hit the balloon/variable interest mess. Nightmare.
During all this, my boyfriend and I cancelled our wedding, nearly broke up, I gained over 100 lbs and developed high blood pressure. I just couldn't handle it.
Imagine my surprise also, when I found out that b/c of the interest rate I owed more money that the original loan when I unloaded this nightmare. That was nearly a year ago. I borrowed money to pay off my credit card debt. So luckily now we are just paying back debt without interest. I have slowly started loosing my weight and my boyfriend and I are starting to plan the wedding.
<Sigh> It's like over 3 years of our lives were sucked into a black hole of heartache. BUT we both feel our relationship is stronger b/c we made it through together.
Unfortunately, I have had much hate in my heart for the real estate agent who turned me on that money man and I loathe the mortgage guy. Most days, I can let it go b/c beautiful things have come into my life. Other days, I hope they have terrible heartache and misfortune in their lives for what they have done to naive people.
I am a hateful person! I had a nightmare roommate who's dog shit everywhere and destroyed things. OH and she stole my last month's rent and deposit! I was so estatic when I found out she had been evicted and laid off.

I read all the articles. What an awful people! Where is the law? It is a shame noone is looking after people like these... They should be banned for life!! But no. They just keep scamming and scamming.....
To take advantage of people who are in "desperation" is dispicable. However, to have a state law system that turns their head on this type of action is even worse!

You guys kills me here. You are lumping Juliette in with Kyle and don't really know anything about what happened. Just because it says something on a website doesn't make it true. If someone is guilty then they are guilty, but if Keystone only had one complaint and it was 3 years ago then it was probably doing things ok. Give me a break. Blogs can do so much harm when used incorrectly and people form mini lynch mobs on people about situations they know nothing about. There are 2 sides to it all.

Bill you are unreal! I am a victim of Kimoto and if you don't think his wife knew any of this was going on you are crazy. I admit I thought I was nieve at the beginning of all of this but now I know that this guy is only out there to scam people. It is obvious that the credit card scam is taken care of, now we who are fighting to keep our homes are dealing with this scammers sidekick Porcelli. I just wish everyone who has been affected by this would come forward.
In total agreement with you on that "Party of Five"! Hoping the other victims from Florida & Nevada see this and come forward.......

Thank you faithmairee, yes this particular scheme is heartbreaking because so many children are involved. Imagine a child asking you if they can keep their toys and wanna know where they will go! I am determined to see justice served and these criminals go to federal prison for a long long time.
The only good thing so far has been Peter Porcelli, he not only owned up to his involvement in the 1st scam, but helped get a guilty verdict on yle Kimoto for his master minding the credit scam. Now we are hoping Porcelli does the same in this "Fraudulent Foreclosure Relief" scheme of kyle & Juliette Kimoto!
1 laughable comment made on Kyle's behalf by his attorney is that Porcelli was the mastermind. Too much evidence proved the attorney wrong on all counts, HOORAY FOR JUSTICE!!!!!!!!
I met Juliette, and my heart goes out to her. She is raising 6 kids on her own while her husband pays for what he did. Whatever happened is a tragedy, and I am not saying that a guilty party should not be held accountable, I am saying that Juliette was obviously not proven guilty, and to judge her without truly knowing is wrong.
I am sorry too Todd, but sadly Juliette's time is coming too. She has known along what Kyle was doing and was very involved in everything he did. I feel sorry for her children. I do know that if this would have been my husband, I would have left with my children and not been involved in any of it. Raising 6 children in this day and age is tough. Maybe if Juliette cooperates with the agencies and tells the truth about their businesses, she can make a plea deal. I don't know what else to say. Families have been broken, children have been deeply affected by the Kimoto's actions, just like her children.
But looking at this bit of new info, I do have a question for you......

SORRY TO SAY, KYLE IS NOT DOING MUCH RIGHT NOW, OTHER THAN SITTING IN JAIL AWAITING HIS SENTENCING. REST ASSURE THAT THE VICTIMS OF BOTH SCAMS WILL BE SENDING NUMEROUS LETTERS TO THE JUDGE ASKING FOR THE FULL 175 YRS PUNISHMENT.
